Welcome to our website.  Please read these Terms and Conditions carefully before using this site.

Who are we?

www.stleonardshospice.org.uk is owned and operated by St Leonard’s Hospice, York (‘we’/‘us’/’our’).  We are a registered charity, no. 509294 and a company limited by guarantee, registered in England and Wales, no. 01451533.  The VAT registration no. is 686521410.  Our registered office is St Leonard’s Hospice, York, 185, Tadcaster Road, York, YO24 1GL.

The term ‘you’ refers to the user or viewer of our website.  Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. By continuing to browse and use our site, you confirm that you accept these terms of use and that you agree to comply with them. These terms of use refer to the following additional terms, which also apply to your use of our site:

  • Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.
  • Cookie Policy, which sets out information about the cookies on our site.
  • Enterprise Terms and Conditions, which sets out the terms if you purchase goods from our site.
  • Donations & Events Terms and Conditions, which sets out the terms if you donate or sign up for a fundraising event through our site.

If you disagree with any part of these Terms and Conditions, please do not use our website.

This website is offered for your personal use only; it must not be used in anyway for any commercial purposes. You must confirm that you are at least 18 years of age.  If you are under the age of 18 years and using this site, then you must have consent from a parent or guardian. In addition, your parent or guardian must be aware of our Terms and Conditions and comply with them in their entirety.

St Leonard’s Hospice reserve the right to withdraw or amend our website service at any time, with no notice required.

St Leonard’s Hospice will not be liable if our site is unavailable at any time or for any period.

Changes

We may change these Terms and Conditions at any time.  Amended versions will apply from the date they are posted. Please check these Terms and Conditions each occasion you use the website. If you continue to use the website you will be bound by the latest Terms and Conditions.

The format and content of this website constantly changes. You should refresh your browser each time you visit the website to ensure that you access the most up to date version.

Contributions 

All content posted or submitted by users of the website, including but not limited to, stories, comments, suggestions and emails (Contributions) must comply with the following Contribution Rules.  Please read these rules carefully before registering as a contributor or submitting any material to this website. If you register as a contributor the Contribution Rules will form part of the contract between you and us.

Your Contributions must not:

  • knowingly be false or misleading;
  • contain any material that is defamatory of any person;
  • contain any material that is illegal, obscene, abusive, vulgar, hateful, or inflammatory;
  • Infringe any copyright, database right or trade mark of any other person;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • promote sexually explicit material;
  • promote violence;
  • promote any illegal activity;
  • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
  • be likely to harass, upset, embarrass, alarm or annoy any other person;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • give the impression that they emanate from us, if this is not the case;
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

You warrant that any such Contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out for Contributions above.

The views expressed by other users on our site do not represent our views or values.

If you have a complaint about any content on this website, please contact us immediately using the Contact Form.  To consider your complaint we need your name, company name if relevant, contact details (a land address, telephone number and email), details of the exact content and why you are complaining about it.  Please note that no action can be taken without this information.

Registration

If you want to make use of certain facilities available through our websites or to carry out certain actions (such as registering to book an event or obtain a newsletter, receiving/streaming regular audio content, ordering a product or contributing comments to a tribute fund or fundraising page) you must first register with us. During registration, you will be asked to provide an individual user name and password which you will need to use each time you carry out the action which you registered for (e.g. each time you purchase a product or submit a Contribution). We may change your username and password if needed.

You must ensure that you keep your username and password confidential and that you do not disclose them to anyone, and that you also restrict access to your computer to prevent unauthorised access to your account. You will be responsible for all activities which occur under your username and password. It is your responsibility to immediately notify us of any known or suspected unauthorised use of your username and password or any other breach of security as soon as you become aware of it.

By registering, you certify that all information you provide in the registration is accurate. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. Contributors to tribute funds or fundraising pages must have a valid email registered with us at all times.

We have the right to disable any registration at any time at our complete discretion, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use

Intellectual Property Rights

You acknowledge that all copyright, trade marks and other intellectual property rights in the website and all photographs, designs, images, text, software, data, audio, video, files and other material in the website or material generated by or transmitted from the website (St Leonard’s Hospice Material) are owned by us. You are permitted to use the website and St Leonard’s Hospice Material only as expressly authorised by us.

Provided you use the website and St Leonard’s Materials in accordance with these Terms and Conditions you are permitted to print off one copy, download and receive extracts of St Leonard’s Hospice Material (Extracts) ONLY for your personal non-commercial use and for private study or teaching purposes or to draw the attention of others within your organisation to content posted on our site, provided in each case that:

  • copyright and source indications are also printed and copied and/or stored in association with the Extracts;
  • no modifications are made to the Extracts and they are not used as part of any other publication or derivative work; and
  • any Extract is retained, printed and/or copied entirely and is not used in a derogatory or misleading context and in particular may not be used for the purpose of promoting, advertising, endorsing or implying a connection with you (or any third party) and St Leonard’s Hospice or its employees.

These rights are not transferable and no other use of St Leonard’s Hospice Material may be made without first obtaining our written permission. In particular, you must not do the following unless you have first obtained our written permission:

  • incorporate any St Leonard’s Hospice Material in any other work, broadcast or publication, whether in hard copy or electronic form; or
  • make any commercial use or publish any St Leonard’s Hospice  Material (other than is necessary for the purpose of viewing or listening to the website in the course of business); or
  • perform, broadcast or otherwise transmit, post, share or make available to the public any St Leonard’s Hospice Material.

The photographic, text, graphic images, audio and video material within any products or publications supplied to you are copyright works and none of them may be copied, reproduced, licensed, broadcast, transmitted or otherwise exploited.

Any rights not expressly granted in these Terms and Conditions are reserved.

We may terminate your rights to use or receive Extracts at any time at our complete discretion.

No reliance on information

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up-to-date.

Limitations of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of or reliance on any content displayed on our site.

If you are a business user, please note that in particular, we will not be liable for:

If you are a consumer user, please note that we only provide our site for domestic and private use. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Different limitations and exclusions of liability will apply to liability arising as a result of:

  • the supply of any goods by use to you, which will be set out in our Terms and conditions of supply, or
  • if you sign up for a fundraising event through our site, which will be set out in our Event Terms.

Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

Applicable Law

If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
